Borrower (“I” or “my”) understands, agrees, and certifies that: (1) all representations are true and complete to the best of my knowledge and belief and shall remain so the earlier of payment in full of any loan or denial of this application; (2) any loan and advances would be based upon Lender’s reliance on my representations; (3) false and misleading information in this Loan Application may result in the denial of this loan request or, if the loan is granted, could result in termination of the loan facility, acceleration of payment and any amounts due under the loan facility, and other legal liability, such as collection costs, expenses, and reasonable attorneys’ fees; (4) the values represented by this quote are preliminary estimates only and do not constitute actual loan terms nor a commitment to make a loan; (5) loans are subject to borrower qualifications, property evaluation, and sufficient borrower reserves; (6) loan approvals are subject to underwriting guidelines and are subject to change without notice based on applicant’s eligibility and market conditions; and (7) I remain responsible for the performance of all obligations under the Note and loan documentation until the loan is paid in full. By execution of the Loan Application and, if applicable, documentation of the loan facility granted, I hereby give my permission to *Flipco Financial and any representatives thereof to take and use pictures of the property covered by the loan facility and testimonials about the results of my loan experience on *Flipco Financial’s website or its other marketing materials, with the understanding that *Flipco Financial shall use reasonable care to protect my privacy regarding this loan experience by not using the full property address, legal description, last name, or precise loan and sale amounts. *Flipco Financial shall mean the applicable subsidiary of Flipco Financial, LLC that extends the loan to you for your project.
